Resolving Issues Collaboratively
Our aim is to help you find the best solutions for your family as constructively as possible.
When relationships break down it can be very difficult to focus on the steps that may need to be taken. Our aim is to help you find the best solutions for your family as constructively as possible. Very few people want to apply to the Court and have the Court impose a solution on them. Most would prefer to reach agreement if possible.
Our Family Lawyers Nicola Codd and Barbara Richardson are collaboratively trained to work with colleagues and with you and your spouse/partner at meetings so that you can resolve the issues together by agreement.
Very few people want to apply to the Court and have the Court impose a solution on them. Most would prefer to reach agreement if possible.
Working collaboratively you will have the opportunity to talk about the things that matter most to you and your family and you will have the space to express your views and be heard. You both provide all relevant information to each other and to each others legal advisors. All legal advice is shared at the meetings, avoiding there being confusion as to differing legal opinions on disputed issues. As far as possible sending letters backwards and forwards between solicitors is avoided which can have a significant impact on the time taken and the costs involved in resolving matters.
To make sure that both solicitors and the couple are all absolutely committed to finding the best solutions by agreement Collaborative Solicitors sign an agreement with you which disqualifies them from representing you in Court if the collaborative process breaks down.
For the collaborative process to work for you, you need to be ready to talk and sometimes this can seem the hardest challenge of all. The solicitors representing both you are there to help and support you both and can also recommend other professionals who can help you manage the emotional impact of the situation.
We also work closely with collaboratively trained independent financial advisers who can look at all the options for you and attend meetings to advise you both.
